Your visa has an expiry date, and in South Africa that date matters more than most people realise. Miss the renewal window and you risk a refused application, an overstay, and a ban from returning to the country. The good news: almost every renewal problem we see at Craig Smith & Associates can be avoided with early planning.
This guide explains when to apply, what to prepare, and what to do if Home Affairs takes longer than expected.
The 60-day rule has been waived: what that means for you
Until October 2026, the Immigration Regulations required renewal, extension and change of status applications to be submitted at least 60 days before your current visa expired. Over the past year, Home Affairs increasingly refused applications for missing this deadline alone.
In October 2026 the Minister of Home Affairs waived this requirement in Immigration Directive 13 of 2026, in anticipation of a High Court matter declaring this regulation to be promulgated irregularly, which is set to be heard at the end of November 2026. The waiver covers future applications, pending applications, and pending appeals where the 60-day rule was the only reason for refusal. Those applications can now no longer be refused purely on the basis that the applicant did not submit the application prior to this time period, but instead needs to be decided on the application’s merits.
Two rules still apply. You must submit your application while your current visa is still valid, and if your visa was issued for less than 30 days, the deadline remains seven working days before expiry. The waiver removes the timing hurdle; it does not lower any other requirement.
Our advice: even with the waiver, start preparing three to four months before expiry and submit early. That gives Home Affairs time to decide before your visa runs out.
Step by step: how a visa renewal works
- Check your expiry date and visa conditions. Note the exact date in your passport, not the date you think it was issued.
- Confirm you can renew from inside South Africa. Most temporary residence visas can be renewed locally, but some changes of status are restricted.
- Gather your documents. Requirements differ per visa category, but usually include a valid passport, proof of financial means, police clearance certificates, and the documents specific to your category (employment contract, spousal proof, proof of registration).
- Complete the online application and book a VFS appointment. Submit in person and pay the fees.
- Keep your VFS receipt safe. This receipt is your proof that you applied on time. You will need it if your visa expires before a decision is made.
- Track your application and collect the outcome at VFS.

Common pitfalls that lead to refusals
- Leaving it to the last minute. Late filing is now allowed, but once your visa expires you generally can no longer apply from inside South Africa.
- Incomplete or expired supporting documents. Police clearances have limited validity.
- Assuming you can change visa type locally. Not every change of status is allowed from inside the country.
- Ignoring your visa conditions. Working on a visa that does not allow it can undermine your renewal.
- Travelling at the wrong time. Leaving South Africa while your application is pending can create problems at the border.
What if Home Affairs hasn’t decided before your visa expires?
Processing times vary, and some applications remain pending well beyond 60 days. For many applicants, Immigration Directive 7 of 2026 offers protection: people who applied for a long-term visa and were still waiting for an outcome on 30 March 2026 have their current visa status extended until 30 June 2027.
This protection has limits. It does not cover pending permanent residence applications, and it ends as soon as you receive your outcome. Applications submitted after 30 March 2026 are not protected in terms of Immigration Directive 7 of 2026.

When to speak to an immigration lawyer
Talk to an attorney before you submit if your visa expires within the next few weeks, you want to change visa type, a previous application was refused, or your application has been pending for months. A short consultation now is far cheaper than an appeal later.
Book a consultation with Craig Smith & Associates to make sure your renewal is submitted correctly and on time.
