What is a General Work Visa?
The General Work Visa is issued under Section 19(2) of South Africa’s Immigration Act. It is intended for foreign nationals who:
- Have a confirmed job offer from a South African employer
- Do not qualify for a Critical Skills Visa
- Can demonstrate that their appointment will not displace a South African citizen or permanent resident
The employer must prove that no suitably qualified South African could be found to fill the role by providing a formal recommendation from the Department of Labour.
Key Requirements
Applicants and employers must meet several key criteria, including:
- A valid employment contract signed by both parties
- A formal Department of Labour recommendation
- Proof that the job was advertised in South Africa, and no local candidates were suitable
- Proof of the employer’s registration with SARS, UIF, and COIDA
- The foreign national’s qualifications and experience relevant to the position
- Police clearance, medical reports, and proof of accommodation
Why is the General Work Visa Complex?
This visa type is often misunderstood and subject to frequent rejection due to incomplete or non-compliant submissions. The process requires coordination between the employer, the Department of Labour, and the Department of Home Affairs.
That’s why legal guidance is highly recommended, especially for first-time applicants or HR departments unfamiliar with immigration procedures.
