Looking to invest or start a business in South Africa? A Business Visa allows foreign nationals to establish or join a company in the country – provided certain legal, financial, and regulatory requirements are met.

At Craig Smith & Associates, we offer specialised legal guidance for business visa applications. With over 20 years of experience in South African immigration law, Craig Smith and his team help entrepreneurs and investors secure legal residency while building compliant and successful businesses in South Africa.

What is a Business Visa?

The Business Visa is issued under Section 15 of the Immigration Act and is designed for foreign nationals who:

  • Want to start a new business in South Africa

  • Want to invest in an existing business

  • Intend to work as an active partner or director in the business

This visa grants temporary residence and may be issued for up to 3 years, with the option to renew. It may also serve as a pathway to permanent residence if the business meets certain sustainability and employment criteria.

Key Requirements

To apply for a Business Visa, you typically need to:

  • Invest a minimum of ZAR 5 million into the business (unless waived for strategic sectors)
  • Submit a business plan showing financial viability and local job creation
  • Prove that the business will employ at least 60% South African citizens or permanent residents
  • Register the business with SARS, CIPC, and obtain all relevant licenses
  • Comply with labour and tax legislation

The business visa process is document-heavy and involves multiple government departments, including Home Affairs, DTIC, and SARS. Errors or inconsistencies in the application, especially in the financial plan, employment strategy, or DTIC motivation, can lead to rejection or long delays.
